The Government of UK desires to manage legal migration in the interests of the UK economy. There are opportunities for people with very different types and level of skills. The UK needs a world class migration system to attract the brightest and the best from across the world, while at the same time being more robust against abuse. The UK welcomes people who come to this country to work and to study but it is improving its immigration system to ensure that they come to the UK legitimately.
UK visas and immigration system is hence changing and is going a major overhaul. The new five tier Point based system has been introduced and expanded and replaces visas like HSMP visas to Tier 1 (General), Work Permits to Tier (2) visas, The points-based system is made up of five tiers and covers most of the immigration categories:
Tier 1 – for highly skilled individuals, who can contribute to growth and productivity. This category replaces the following visas: Highly Skilled Migrant Programme (HSMP) to Tier 1 (General), Investors to Tier 1 (Investor), Business persons and Innovators to Tier 1 (Entrepreneur), Fresh Talent: Working in Scotland Scheme and International Graduates Scheme to Tier 1 (Post-study work)
Tier 2 – for skilled workers with a job offer, to fill gaps in the United Kingdom workforce. This category replaces old Work Permits scheme, intra company transfers, sportsperson, minister of religion, overseas qualified nurses and midwives,
Tier 3 – for limited numbers of low-skilled workers needed to fill temporary labour shortages
Tier 4 – for students, who wants to study in the UK
Tier 5 – for temporary workers and young people covered by the Youth Mobility Scheme, who are allowed to work in the United Kingdom for a limited time to satisfy primarily non-economic objectives. This category replaces short term visas for sportsperson,
The following categories outside the points-based system are still open but are under review:
sole representatives of overseas firms
domestic workers in private households
representatives of overseas newspapers, news agencies and broadcasting organisations
The five tiers have different conditions, entitlements and entry-clearance checks. This makes the system to adapt immigration policy on points and sponsorship to the very different needs of people entering the United Kingdom to work and study.
Tiers 3 and 5 are temporary routes. Migrants in these tiers cannot switch out of them once they are in the United Kingdom. Tier 3 is currently suspended indefinitely.
Migrants in Tiers 1, 2 and 4 can switch between these tiers, if they meet the requirements of the tier they want to switch to. Those in Tiers 1 and 2 can eventually settle in the United Kingdom, if they meet the settlement requirements at the time when they apply to settle.
Migrants’ dependants are allowed into the United Kingdom under Tiers 1, 2, 4 and 5, except where the main applicant is here under the Youth Mobility Scheme in Tier 5. However, dependants are not allowed to work if they are accompanying a Tier 4 student or a Tier 5 temporary worker who has been given permission to stay here for less than 12 months.
